Whereby, having recited: firstly, PA491/74/1; secondly and thirdly, PA491/74/5,6; fourthly, PA491/74/8; fifthly, that Charles Radenhurst (in 1838 described as of Birmingham, Warwickshire, bankrupt innkeeper) did pay Joseph Garner (in 1838 of Dunchurch, Warwickshire, bankrupt innkeeper) the £350, as the latter's assignees Robert Welshman (of Eathorpe, Warwickshire, farmer and maltster), Benjamin Johnson (of Dunchurch, draper) and John Bray (of Shilton, Warwickshire, farmer) and the man himself acknowledge; sixthly, that on 9 Mar 1837 a fiat in bankruptcy was issued against Joseph Garner and that on 30 Mar 1837 his creditors, meeting at the "Craven Arms", Coventry, appointed Robert Welshman et al assignees; seventhly that, having recited that Charles Radenhurst owed the Lichfield, Rugeley & Tamworth Banking Co. £7,000, besides Achurch, Spooner & Co. of Birmingham £2,300 on mortgage for his property in that town, on 22 Feb [sic] 1837 it was agreed that the first-mentioned bank's directors Thomas Rowley, Jeremiah Ginders, William Knight and Thomas Simcox should hold a mortgage upon Birmingham property, some elsewhere, and the "City Hotel" (whose title deeds had been deposited with Mr. Henry Moore Griffiths to secure £700 plus interest as he was solicitor to John Murdock (of Handsworth, Staffordshire, gentleman)); eighthly, that Thomas Rowley et al have not paid the £2,300 to Attwoods but that C. Radenhurst owes T. Rowley et al another £5,000; ninthly, that on 11 May 1837 a fiat in bankruptcy was issued against C. Radenhurst, and that on 24 Jun 1837 at the "Royal Hotel", Birmingham his creditors appointed William Richards Marston (of Birmimngham, plumber and glazier), Joseph Ludlow (of Birmingham, butcher) and Edward Radenhurst (of Birmingham, lamp-manufacturer) his assignees and the fiat was enrolled; tenthly, that William Richards Marston et al auctioned the "City Hotel" on the premises [no date] to Charles Jefferies (of Bedworth, Warwickshire, gentleman) for £1,235; eleventhly, that Charles Jefferies has agreed that John Aston (of Coventry, innkeeper) should substitute for him, to achieve which he is lending him £1,200; twelfthly, that the mayor, bailiffs and commonalty possessed the premises qua Nicholas Chambers' Charity trustees for the benefit of the poor children of Bablake Hospital [School]; thirteenfthly, that, under the [1835] Municipal Reform Act, the Lord Chancellor [Cottenham] on 23 Feb 1837 appointed Reverend Thomas Sheepshanks (of Coventry, clerk [in Holy Orders]), Thomas Banbury (late of Coventry, now of Leamington Priors, Warwickshire, esq. [shag-manufacturer]), James Beck (of Coventry, esq. [banker]), John Herbert (of Coventry, silkman), Joseph Ford (of Coventry, gentleman [appraiser]), Joseph Howe (of Coventry, dyer), Josiah Cash (late of Coventry, now of Leamington Priors, gentleman [ribbon-manufacturer]), Richard Hands (of Coventry, ribbon-manufacturer), William Prime (of Coventry, gentleman [banker]), Thomas [Schumann] Morris junior (late of Coventry, now of Manchester, Lancashire, carrier), James Sibley Whittem (of Coventry, currier), Thomas Smith junior (of Coventry, grocer), William Clark (of Coventry, ribbon-manufacturer), Richard Caldicott (of Coventry, ribbon-manufacturer), Thomas Pepper (of Coventry, gentleman [banker]), Richard Kevitt Rotherham (of Coventry, esq. [ribbon-manufacturer]), Robert Arrowsmith (of Coventry, doctor of physic), James Wall (of Coventry, gentleman), Stephen Hammerton (of Coventry, ribbon-manufacturer) and Harry Chetham (of Coventry, liquor-merchant), along with the since-deceased Robert Bunney [no description], the charity's trustees; fourteenthly, that the £700 principal alone is due to John Murdock; fifteenthly, that C. Radenhurst owes T. Rowley et al over £5,000; sixteenthly, that Rowley al should receive residuary purchase money in part discharge; and seventeenthly, that William R. Marston et al, C. Radenhurst and Rowley et al have got Robert Welshman et al and J. Garner to participate regarding his moiety: therefore (in consideration of £700 paid by C. Jefferies to J. Murdock, £500 by Jefferies to Rowley et al, and £30 by John Aston to Rowley et al, which sums total £1,235, and of 10/- by Jefferies to each of W.R. Marston et al , C. Radenhurst, R. Welshman et al and Garner) W. Marston et al, Welshman et al, C. Radenhurst, Garner, Murdock, Rowley et al and J. Aston consign to Jefferies the "City Hotel" (occupied by Aston) for the 1820 term's residue and repayment by Aston to Jefferies of £1,200 with £4% per annum interest; Jefferies may transfer the premises to Aston if he repay the mortgage, but neither will transfer the lease to a third party without Reverend Thomas Sheepshanks et al's permission; Thomas Sheepshanks et al may re-enter if rent fall 21 days behindhand or there be breach of covenant; renewal terms as in PA491/74/1; if there be default in payment after next 20 Mar, Jefferies may give Aston three calendar months' notice of sale or may sell the hotel at any time following breach of covenant; if Jefferies take out the further 21-year terms, he may sublet to Aston for equal periods less one or two days; any charge which Jefferies shall have to pay on Aston's behalf shall be subject to £5% per annum interest upon the £1,200; Aston shall pay costs of obtaining renewal leases; Aston shall insure with the Coventry & Warwickshire Fire Insurance Office for at least £1,000, paying premiums within 21 days plus £5% per annum interest thereafter to Jefferies; total principal shall not exceed £2,000; re-entry if interest on the £1,200 fall a fortnight behindhand upon half-yearly payments; total stamp duty will be £28 on principal parties' copy of the deed, £13/16/- on T. Sheepshanks et al's.

31 Jan 1840. Assignment of Mortgage [endorsed on second-innermost skin] whereby, having recited that John Aston has paid Charles Jefferies £400 with interest, therefore (in consideration of the £800 balance paid to C. Jefferries and 5/- to J. Aston, both by Jonathan Bray (of Stoke, Coventry, gentleman)), on behalf of Reverend Thomas Sheepshanks et al (less the late Joseph Howe) Jefferies and Aston transfer to Jonathan Bray the premises for redemption of £800 plus £5% per annum interest on 31 Jul [1840].

22 Dec 1841. Security [endorsed on fourth-outermost skin] whereby, having recited: firstly, that John Aston and Jonathan Bray applied to Reverend Thomas Sheepshanks et al for the first renewal of the lease, to which they agreed; but secondly, that J. Aston died on 29 Jun [1840], by his 19 [Jun 1840] will leaving his leasehold to Ann Aston (in 1841 described as of Coventry and his widow); and thirdly, PA491/74/10: therefore, in consideration of 5/- paid by J. Bray to Ann Aston, she charges the premises to him with the consent of Thomas Sheepshanks et al (less William Prime).
