Whereby, having recited: firstly, that the late William Perkins of Warwick by his 13 Aug 1820 will [catalogued at CCA/2/3/433/50] left his Coventry and Southam (Warwickshire) property to his friends Thomas Handley (of Barford, Warwickshire, gentleman) and John Summers (of Coventry, ironmonger) as trustees; secondly, that William Perkins died on 6 Jun 1821 and that his will was proved in the Prerogative Court of Canterbury on 26 [Jun 1821]; thirdly that, by a lease and release (dated 5-6 Apr 1821) wherein John Summers was of the first part, Letitia Perkins {of Leamington [Spa], Warwickshire, widow} [phrases in curly brackets in this entry are taken from PA2433/3/57.XVI] of the second, Frederick Tabberer {of Leamington [Spa]} and his wife Mary Ann (a daughter of W. Perkins) of the third, William Handley {of Barford, gentleman} of the fourth and Richard Robbins {of Leamington, gentleman [bath proprietor]} of the fifth (having rehearsed W. Perkins' will and probate, his daughter Letitia Perkins junior's death on 13 May 1829, Thomas Handley's decease on 21 Jan 1831 and that Letitia Perkins [senior] and the Tabberers wanted to appoint Richard Robbins as a trustee in place of T. Handley), John Summers appointed Richard Robbins to act alongside him as a trustee and to William Handley still-unsold premises for J. Summers' and R. Robbins' use; fourthly, the 6 Sep 1845 settlement whereby (having rehearsed: first, W. Perkin's will and probate, Letitia Perkins junior's death, Mary Ann Tabberer's death on 20 Jun 1832 intestate, the Tabberers' issue (Ellen Letitia, by 1845 an adult spinster living at Leamington; and William Frederick (in 1851 descrbed as of Leamington, gentleman) and Jane (in 1851 of Leamington, spinster) who were in 1845 still minors); second, that Wade Hampton Smith {of 16, Avenue Road, Saint John's Wood, Middlesex, gentleman} was to marry Ellen Letitia Tabberer; third, that £3,000 was to be raised upon property to which Ellen L. Tabberer was entitled, payable to her betrothed while she was his wife; and fourth, that William Canning and Samuel Canning (in 1851 of Sherbourne, Warwickshire, gentlemen) had agreed to lend the bride £3,000), in consideration of £3,000 paid by William and Samuel Canning to Wade Hampton Smith, E. Tabberer entrusted the Cannings with her one-third share of this deed's messuage for repayment by her or her prospective husband of £75 (= half a year's interest) on 6 Mar [1846] and £3,075 on 6 Sep 1846 with power of sale if default; fifthly that, having recited the marriage settlement, in consideration of the marriage Ellen Lettia Tabberer {a daughter of Frederick Tabberer of Warwick, surgeon} on 8 Sep 1845 transferred (with Wade Hampton Smith's consent) to R. Robbins and Francis Robbins (in 1851 of Kenilworth, Warwickshire, gentleman) her share, subject to the £3,000, to be held by them successively for her until the wedding, then (with her consent and that of the holders of the other two thirds) with power to sell her share (Frederick Tabberer, William FrederickTabberer and Jane Tabberer also participated); sixthly, the 24 Jun 1851 conveyance (having rehearsed: first, W. Perkins' will and death, Thomas Handley's demise, the 5-6 Apr 1832 indentures, Mary Ann Tabberer's decease, John Summer's expiring on 30 Jun 1846 and the survival by his co-trustee R. Robbins; second, that William F. Tabberer {of Leamington, gentleman} was entitled to one third of the estate detailed in the reciting deed's schedule's second division (which included the main deed's premises); and third, that W.F. Tabberer had asked R. Robbins to convey his share to him) by R. Robbins to W. Tabberer of his share of inter alia this deed's hereditaments, plus a declaration that W. Tabberer was married during Jun 1848 but that his wife might not dower from the property; seventhly, the 24 Jun 1851 conveyance (having rehearsed: first, as in the previously-recited deed; second, that J. Tabberer was entitled to the third third of inter alia the main deed's premises; and third, that she had asked R. Robbins to convey her her share) by R. Robbins to J. Tabberer of her share; eighthly, that Ellen Letitia Smith died during Apr 1848 and was buried in Leamington parish church on 14 Apr 1848; ninthly, that R. Robbins, Francis Robbins junior, W. Tabberer and J. Tabberer had the premises to which the 1845 and 1851 deeds related auctioned by John Margetts at the "King's Arms", Coventry on 4 Jul [1851], whereupon Richard Brevitt (of Coventry, Warwickshire, ironmonger) bid highest; and tenthly that, as they are only owed the £1,500 principals, W.and S. Canning should receive £500 of the purchase-money in part discharge because the remaining hereditaments will form sufficient security for the balance of the loan: therefore (in consideration of payment by Richard Brevitt of £500 to the Cannings, £70 to the Robbinses, £570 to W. Tabberer and £570 to J. Tabberer) the Cannings (as regards the 6 Sep 1845 transaction), R. and Francis Robbins (regarding the 8 Sep deed), R. Robbins and W. Tabberer (respecting that assignment) and J. Tabberer sell R. Brevitt a messuage in High Street and Greyfriars' Lane (successively occupied by Messieurs Cooper & Summers, [Charles] Noyes and now the purchaser) as per marginated plan on this deed's fifth skin; to be held freed from the 6 Sep 1845's mortgage, with Richard Dewes (of Coventry, gentleman [solicitor]) as trustee; the Cannings and W. Tabberer covenant to produce the 1832 deeds, as do the Cannings and the Robbinses the 6 Sep 1845 settlement, the Robbinses the 8 Sep 1845 assignment, W. Tabberer the 24 Jun [1851] deed which R. Robbins made with him, and J. Tabberer that of the same date which R. Robbins made with her.
