Whereby, having recited: firstly, CCA/2/3/473/13; secondly, CCA/2/3/473/16; thirdly, that there has been no sale; fourthly, CCA/2/3/433/50; fifthly, that William Perkins has died and that his will has been proved on 26 Nov 1821; sixthly that, having rehearsed, first, that W. Perkins' debts had been paid and second, that Thomas Handley and John Summers (in 1844 described as of Coventry, ironmonger) dealt with certain canal shares and personalty and with the mortgage mentioned in CCA/2/3/473/16, hence they stood seised of Mary Ann Perkins' £9,000 annuity under her father's will under the terms of her 9 May 1821 marriage settlement with Frederick Tabberer (in 1844 formerly of Warwick, surgeon but then of Pantan Street, Haymarket, Middlesex), her mother and sister Letitia [I] and Letitia [II] Perkins also participating; seventhly, that Letitia [iI] Perkins' will (13 Feb 1829) left residuary personalty to her mother, T. Handley and John Summers; eighthly, that L. [II] Perkins has died and that her will was proved on 3 May 1829; ninthly, that Handley died on 21 Jan 1831; tenthly, that on 6 Apr 1832 Richard Robbins (in 1844 of Leamington Priors, Warwickshire, gentleman [bath-proprietor]) was appointed a trustee of CCA/2/3/433/50 and of L. [II] Perkins' will, and of the marriage settlement, in order to manage securities which serviced the £9,000's trust (including CCA/2/3/473/16) along with J. Summers and L. [I] Perkins as appropriate under a deed of appointment which also involved Frederick Tabberer and his wife and William Handley, gentleman; eleventhly, that Mary Ann Tabberer died on 20 Jun 1832; twelfthly and thirteenthly, CCA/2/3/433/23's recitals of first Thomas [I] Burbidge's will and second his death and probate; fourteenthly that, on behalf of John Russell (formerly of Warwick, banker; now of Leamington Priors, esq.), Thomas Stephens (silversmith) and Bryan Dunn (tanner and currier), both of Coventry, have contracted to sell Richard Bliss [I] Burbidge (of Coventry, grocer) CCA/2/3/473/16's premises for £2,160, hence CCA/2/3/473/23; fifteenthly, that the said £1,500 principal alone is due; and sixteenthly, that it has been agreed that £1,500 of the £2,160 should be paid to Summers and Richard Robbins and the term be assigned: therefore (in consideration of £1,500 paid by Richard B. [I] Burbidge to Summers and R. Robbins with the agreement of Letitia [I] Perkins (of Leamington Priors, widow) and F. Tabberer, and 5/- by R.B. [I] Burbidge to John Russell) on behalf of Summers, Robbins, Thomas Stephens, Bryan Dunn, Letitia [I] Perkins and F. Tabberer J. Russell consigns to R.B. Burbidge CCA/2/3/473/16's premises with Thomas [II] Burbidge (of Kenilworth, Warwickshire, commission agent) as trustee; moreover, in consideration of the aforesaid £1,500 and of 10/- apiece paid to Summers, Robbins, T. Stephens and B. Dunn, they assign to John Fortescue (of Warwick, gentleman) CCA/2/3/473/13's term in trust to attend the inheritance; Summers and Robbins covenant to produce the marriage settlement and deed appointing a new trustee for John Fortescue and R. Burbidge.
