Ann Gilbert is one of the daughters of the late Richard Russell of Fillongley, yeoman; John Meigh is the eldest son and heir of the late John Meigh of Fillongley by his wife Mary who was previously Mary Cheney, spinster; Ann Johnson and Thomas Meigh are the only surviving younger children of John Meigh by Mary Cheney. Reciting indentures of lease and release dated 19 and 20 Jul 1733, marriage settlement between (1) John Meigh the elder of Fillongley, gentleman (grandfather to the John Meigh who is party to the indenture of 1767) and his wife Mary (one of the daughters of the late Thomas West of Meriden, gentleman), (2) John Meigh the younger, son and heir of John Meigh the elder (father to the John Meigh who is party to the indenture of 1767), (3) John Cheney of Haseley, gentleman, and his only daughter Mary Cheney, John Burbery of Carsley [Keresley], gentleman, and Thomas Gregory of Offchurch, gentleman, and (4) William Jones of Haseley, clerk, and Richard Russell of Fillongley, yeoman, relating to the following property:- (A) messuage etc and closes called Hurst Wood Field and the Stockings (then divided into 5 parts), 2 woods called Hurst Wood and the Three Cornered Grove, in Meriden in the occupation of John Meigh and Samuel Docker; (B) a cottage and closes called Sparkes's Close, The Round Croft, The Long Croft, The Birchy Croft in Meriden, theretofore in the possession of William Featherstone, deceased, then or late Robert Sparkes and Gilbert Docker; (C) 4 woods called Jennings Wood, Waterwood, Hally Hagg and Nether Richmore, then in the possession of John Meigh the elder, John Meigh the younger and Martha Reddall, widow. With regard to (A) this is to the use of John Meigh the elder and his wife Mary; (B) is to the use of Martha Reddall of Fillongley, widow (the other daughter of Thomas West) and then both to the use of John Burbery and Thomas Gregory for the life of John Meigh the younger. With regard to (C) two thirds of this are to the use of Mary Cheney and her assigns and the remaining one third (plus other lands in Allesley) after the deaths of John Meigh the younger and Martha Reddall to Burbery and Gregory for the use of Mary Cheney. The other trustees (Richard Russell and William Jones) were empowered to mortgage the property to raise £600 for the younger children of John Meigh the younger. The marriage between John Meigh the younger and Mary Cheney took place soon after the marriage settlement. John Meigh the elder and his wife Mary, Martha Reddall and Mary the wife of John Meigh the younger, all died in the lifetime of John Meigh the younger. In his will dated 20 Nov 1752, John Meigh the younger directed that the £600 for his three younger children be raised by Russell and Jones. Mary Meigh, one of the younger children died unmarried and under the age of 21 during her father's lifetime. After the death of John Meigh the younger, doubts arose as to whether the two other younger children were entitled between them to the full £600. It was agreed that they were only entitled to £200 each. (see PA1896/9/3/3). John Meigh, the eldest son of John Meigh the younger, in order to pay the £400 and for other reasons, has borrowed £800 from Robert Lees on a mortgage of the premises. William Jones, one of the trustees of the marriage settlement, has died; subsequently his co-trustee Richard Russell died intestate and letters of administration were granted one of his daughters, Ann the wife of James Gilbert. Now for £200 from John Meigh to William Johnson and his wife Ann and for £200 from John Meigh to Thomas Meigh, Thomas and Ann Gilbert, at the request of John Meigh, William Johnson and his wife Ann, and Thomas Meigh, mortgage to John York, as the trustee of Robert Lees, the property as above, in order to secure the repayment to Lees of the £800
