Abstract of the Title of Joseph Barnes [I]' Devisees to Hereditaments in and near Coventry

I 16 Feb 1847. Will of Joseph Barnes senior (of Coventry, gentleman) whereby the testator left to his wife Rebecca his Butts Lane residence with a garden, also an £80 annuity which was payable out of property which he had not given her; to his [builder-]son Edward Turner Barnes, the Smithford Street messuage which that man occupied unless he tried to mortgage it, also a £15 annuity; to his executors during the lifetime of the testator's son George, 14/- per week unless he alienated it, whereupon that money would pass to the residuary legatees; of the residuary estate, one quarter was destined for the testator's son Joseph [II] for life, whereafter half thereof would be shared between the testator's late daughter Elizabeth Mercer's children and the other half between his daughter Susannah Lee's; a second quarter would go to the testator's [watch-manufacturer] son-in-law Thomas James Mercer [I] for life and then be shared between the late E. Mercer's children with cross-remainders; the third quarter would pass to the testator's daughter Sarah the wife of [the tax-assessor] Thomas Hall Page for life and then one moiety thereof to E. Mercer's children and the other between S. Lee's; the remaining quarter went to the said S. Lee (wife of John) for life with equal remainder between her children.
II 7 Jun 1848. Codicil which revoked the bequest to Edward Turner Barnes, giving him instead one-fifth of the residuary estate for life, then as the will had intended for Joseph Barnes [II]' and Sarah Page's after their deaths, so its quarters were reduced to fifths.
III 17 Apr 1850. Joseph Barnes [I] died.
IV 4 Oct 1850. Will proved at Lichfield.
V 30 Oct 1862. Rebecca Barnes died.

N.B.: Elizabeth Mercer's children were Caroline (who married Francis Trepess), Thomas James Mercer [II] ("the father"), James Davey Mercer. William Satchwell Mercer, Elizabeth, Joseph Barnes Mercer, Frederick Clarke Mercer, Harriett (who married James Batting Winch [sic]), and Emily (who married John Prue).
N.B.: Susannah Lee's children were Ellen (who married Samuel Henry Holland), William Barnes Lee, Elizabeth, Sarah Page Lee, Rebecca Barnes Lee (who married (1) Thomas James Mercer [II] and (2) Vincent Frederic Louis Marindin) and Mary Eleanor.

B As to the Share of Caroline Mercer
XII 16 Jun 1892. Statutory Declaration by Joseph Barnes Mercer (insurance agent) and Sylvester Richard Masser (solicitor), both of Coventry, about the former's sister Caroline's marriage with Francis Trepass, their conveyance of their share of Joseph Barnes [I]' estate to Thomas James Mercer [II] who was the declarator's brother, and that that money was paid after the testator's death as he had stipulated; Sylvester Richard Masser believed that the deed of conveyance to Caroline Mercer had been lost.
XIII 16 Feb 1874. Will of Thomas James Mercer [II] (of Hertford Terrace, Coventry, watch-manufacturer) which left realty to his wife and executrix Rebecca Barnes Mercer and his executors Charles Webb Iliffe (medical doctor) and William Clarke (chemist and druggist), both of Coventry, in trust for sale and investment of the proceeds so that Rebecca Barnes Mercer might receive the income for life, it then being shared betwen his sons Thomas James Mercer [III] ("the son"), Harry Stanley and Frank Louis equally.
XIV 24 Sep 1875. Thomas James Mercer [II] died.
XV 7 Dec 1875. Will proved at Birmingham.

C As to the Share of James Davey Mercer
XVI 15 Oct 1865. Fire-damaged indenture endorsed as an Assignment of Interest under Joseph Barnes [I]' will by James Davey Mercer to Robert Harvey Minster [solicitor] to receive £100 and interest.

D As to the Share of William Satchwell Mercer
XVIII 16 Jun 1892. Statutory Declaration by Joseph Barnes Mercer and Sylvester Richard Masser that William Satchwell Mercer sold his share to John Lee, who had received the money, as had those entitled thereto under William S. Mercer's will following J. Lee's death; the relevant conveyance was assumed to have been lost,
XIX 9 Jan 1847. Will of John Lee (of Birmingham, Warwickshire, surveyor of taxes) which left all to his wife Susannah during her widowhood, then division equally between their children, and named as executors Thomas Hall Page of Stoke near Coventry, David Spencer of Coventry [draper] and the wife.
XX 23 Oct 1854. John Lee died.
XXI 2 Jul 1859. Will proved at Birmingham.

E As to the Share of Elizabeth Mercer, deceased
XXII 25 Mar 1855. Elizabeth Mercer died intestate at Saint Helier, Jersey, leaving her father Thomas James Mercer [I] her heir at law.
XXIII 17 Oct 1865. Will of Thomas James Mercer [I] which left personalty to his namesake son and John Mills Stevens, whom he named his executors.
XXIV 28 Apr 1866. Thomas James Mercer [I] died.
XXV 11 Apr 1867. Will proved at Birmingham.
XXVI 20 Jul 1876. Letters of Administration for Elizabeth Mercer's estate were granted to William Clarke as executor of Thomas James Mercer [II] who had meanwhile died (John Mills Stevens having renounced probate).

F As to the Share of Joseph Barnes Mercer
XXVII 28 Nov 1866. Mortgage whereby, having recited: firstly and secondly, Joseph Barnes [I]'s will and codicil; thirdly, his death and probate; fourthly, the deaths of John Lee, Rebecca Barnes, Joseph Barnes [II], Edward Turner Barnes, Thomas James Mercer [I] and Thomas Hall Page; fifthly, that Thomas J. Mercer [I] and Elizabeth nee Barnes had had nine children, of whom Joseph Barnes Mercer (of Coventry, watchmaker) was one and adult; and sixthly, that that man had asked Henry Dry (of Coventry, house agent) to lend him £100: therefore Joseph Barnes Mercer charged his share therewith for repayment at £5% per annum interest on 28 May [1868].
XXVIII 6 Feb 1878. Mortgage whereby, having recited: firstly to thirdly, Joseph Barnes [I]' will, death and probate; fourthly, the deaths of Rebecca Barnes, Edward Turner Barnes, Joseph Barnes [II], Thomas James Mercer [I] and Thomas Hall Page; fifthly, that Joseph Barnes Mercer was one of Elizabeth Mercer's children; and sixthly, that Joseph Anstey (of Coventry, draper) had agreed to lend him £160: therefore Joseph B. Mercer charged his share therewith for repayment at £5% per annum interest on demand.
XXIX 31 Jul 1879. Whereby, having recited: firstly, XXVIII; and secondly, that Joseph Anstey had agreed to make further loans up to a total of £190: therefore Joseph Barnes Mercer charged his share therewith for repayment at £5% per annum interest from 1 Mar [1879] upon demand.
XXX 9 Dec 1881. Conveyance whereby, having recited: firstly, XXVII; secondly, that that deed's sum had been discharged but no conveyance made; thirdly and fourthly, XXVIII, XXIX; fifthly, that Joseph Barnes Mercer (of Coventry, Warwickshire, watch-manufacturer) had agreed to sell his share to Joseph Anstey (of Coventry, draper) for £400; sixthly, that Henry Dry (of Coventry, house agent) had agreed to participate; and seventhly, that Joseph Barnes Mercer owed Joseph Anstey £400 for principal and interest: therefore (in consideration of the £440 aforesaid and £20 to make a purchase-price paid by J. Anstey to Joaeph B. Mercer and of 5/- by Anstey to Henry Dry) H. Dry and J.B. Mercer conveyed the share to Anstey.

G As to the Share of Frederick Clarke Mercer
XXXI 6 Feb 1890. Conveyance whereby, having recited: firstly and secondly, Joseph Barnes [I]'s will and codicil; thirdly, his death and probate; fourthly, the death of John Lee on 23 Oct 1858; fifthly, the deaths of Rebecca Barnes, Joseph Barnes [II], Edward Turner Barnes, Thomas James Mercer [I] and Thomas Hall Page (who died on 20 Aug 1866); sixthly, that Frederick Clarke Mercer (of Portage La Prairie, Manitoba, Canada) was a child of Elizabeth Mercer the daughter of Joseph Barnes [I]; seventhly, that George Barnes and Sarah Page were still alive; eighthly, that Susannah Lee had died; and ninthly, that Frederick Clarke Mercer had contracted to sell Thomas James Mercer [III] (of Coventry, watch-manufacturer) his interest: therefore for £180 Frederick C. Mercer conveyed his share to Thomas James Mercer [III].

H As to Emily Prue's Share
XXXII 4 Jul 1870. Conveyance whereby, having recited: firstly and secondly, Joseph Barnes [I]' will and codicil; thirdly, his death and probate; fourthly, the deaths of John Lee, Rebecca Barnes, Joseph Barnes [II], Edward Turner Barnes, Thomas James Mercer [I] and Thomas Hall Page; fifthly, that Emily Prue (in 1870 described as the wife of John Prue of Warwick, cabinetmaker) was one of Elizabeth Mercer's children; sixthly, that George Barnes, Susannah Lee and Sarah Page were still alive; seventhly, the 18 Jul 1867 marriage settlement whereby Emily Prue (then Mercer) entrusted to George Lloyd and Francis Trepass her share to her own use until marriage and then as she might appoint; eighthly, that John Prue married Emily Mercer; and ninthly, that the couple had contracted to sell her share to Thomas James Mercer [II]: therefore for £130 they sold him Emily's share.
XXXIII 5 Jul 1870. Mortgage whereby Thomas James Mercer [II] charged that share to Henry Hiorns [I] (of Penzance, Cornwall, gentleman) for redemption of £100 at £5% per annum interest on 5 Jul [1871].

XXXIV 9 May 1892. Reconveyance whereby, having recited: firstly, XXXIII; secondly, Thomas James Mercer [II]'s will; thirdly, his death and probate; fourthly, that Rebecca Barnes Mercer married Vincent Louis Frederic Marindin at Saint Michael's, Coventry on 13 May 1877; fifthly, that Henry Hiorns [I]' 12 Oct 1868 will left mortgages to his children Elizabeth and Henry [II], whom he named executors; sixhly, his 5 Nov 1877 codicil which confirmed the trust and appointment; seventhly, that on 13 Nov 1886 Henry Hiorns [I[] died at Penzance and that the will was proved on 25 Nov 1886; ninthly, that Rebecca Barnes Marindin died at Grantham[, Lincolnshire] on 18 Feb 1888; and tenthly, that Thomas J. Mercer [II] paid H. Hiorns [I] the moneys on 1 Jan 1873: therefore Elizabeth Hiorns (of Leamington [Spa], Warwickshire, spinster) returned to Charles Webb Iliffe and William Clarke Elizabeth Prue's share.

I As to Ellen Holland's share
XXXV 13 Oct 1852. Marriage Settlement whereby, having recited: firstly that, as a child of Susannah Lee, Ellen Lee (of Edgbaston near Birmingham, Warwickshire, spinster) was entitled to a share in Joseph Barnes [I]' estate and an expectation of others; and secondly, that she was going to marry Samuel Henry Holland (of Birmingham, paper dealer): therefore she entrusted William John Stevens (of Edgbaston, gentleman) and Frederick Smith (of Birmingham, brass-founder) with the interest, they to act as her attorneys to accept any disposition which the will's trustees might effect; to be held successively for Ellen Lee until marriage, for her separate use while married, for her during her widowhood and for the couple's children as they might have appointed or else in equal proportions at 21 or an earlier female marriage; William John Stevens and Frederick Smith might lease any property for up to 99 years, sell it with authority from the interested parties or mortgage it; the couple might replace trustees while alive, or a surviving trustee do so when they were both dead.
XXXVI 15 May 1892. Appointment of a New Trustee whereby, having recited: firstly, XXXV; secondly, that Frederick Smith (of Birmingham, brass-founder) had never acted and wished to retire from the trusteeship; and thirdly, that the property concerned comprised Ellen Holland's shares in Joseph Barnes [I]' estate and money: therefore Samuel Henry Holland (of 244, 17th. Street, Brooklyn, New York, United States of America, printer) and his wife Ellen appointed William Thomas Stubbs (of Sutton Coldfield, Warwickshire, bank accountant) to replace Frederick Smith.

J As to the Share of William Barnes Lee
XXXVII 2 Apr 1859. Will of William Barnes Lee of Birmingham, Warwickshire which left all to his sisters Ellen Holland and Elizabeth, Sarah and Rebecca Lee, and named his uncle Thomas Hall Page and David Spencer of Coventry executors.
XXXVIII 2 Jun 1868. William Barnes Lee died.,
XXXIX 7 Mar 1884. Limited Probate granted under 5 Feb 1884 decree to David Spencer until the original will or a more authentic copy had been discovered than that which was utilised to facilitate the decree.

K As to the Share of Sarah Page Lee
XL 23 Apr 1866. Will of Sarah Page Lee who left everything to her aunt and executrix Sarah Page with whom she had lived since a child.
XLI 29 Nov 1868. Sarah Page Lee died.
XLII 3 Apr 1882. Will of Sarah Page (of Coventry, widow) which named as executors her friends William Clarke (chemist and druggist) and Joseph Anstey (draper) and great-nephew Thomas James Mercer [III] (watch-manufacturer), all of Coventry; residuary estate should be sold and the clear proceeds paid to her niece Ellen Holland.

L As to the Share of Elizabeth Lee

XLVII 10 Feb 1870. Will of Elizabeth Lee which appointed Thomas James Mercer [II] and William Le Roy (of Birmingham, Warwickshire, gentleman) executors upon trust to sell her estate and invest the proceeds so as to pay the yearly income to her mother Susannah Lee for life, then equally between Ellen Holland and Rebecca Barnes Mercer.

M As to Rebecca Barnes Marindin's Share
LIV 2 Aug 1866. Trust Deed whereby, having recited: firstly to thirdly, Joseph Barnes [I]' will, codicil and death; fourthly to sixthly, Rebecca Barnes', Joseph Barnes [II]' and Edward Turner Barnes' deaths; seventhly and eighthly, John Lee's will and death; ninthly, that five of John and Susannah Lee's children attained their majorities; and tenthly, that Rebecca Barnes Mercer had agreed that her interest under Joseph Barnes [I]' and John Lee's wills should be assigned to Oliver Minster (of Coventry, gentleman [solicitor]): therefore she and Thomas James Mercer [I] entrusted Oliver Minster therewith as Thomas J. Mercer [I] might appoint.
LV 20 May 1868. Mortgage whereby, having recited: firstly, LIV; but secondly, that Thomas James Mercer [I] needed £420: therefore he charged his share to Susannah Lee (of Stoke, Warwickshire, widow) and David Spencer (of Coventry, mercer) for redemption of £420 at £5% per annum interets on 20 Nov [1868].

Adams to act in trust for any children of the marriage.

Release whereby. having recited: firstly, Joseph Barnes [I]' will and codicil; secondly, his death; thirdly to fifthly, Rebecca Barnes', Joseph Barnes [II]' and Edward Turner Barnes' deaths; sixthly, John Lee's will, death and probate; seventhly, John and Susannah Lee's children, of whom Mary Eleanor died on 27 Sep 1887; eighthly, Susannah Lee's death; ninthly, Rebecca Barnes Lee's marriage to Thomas James Mercer [II]; tenthly, LIV; eleventhly, LV and the discharge; twelfthly, Thomas J. Mercer [II]'s will; thirteenthly, his death and probate; fourteenthly, LVI; fifteenthly, that Rebecca Barnes Mercer married Vincent Louis Frederic Marindin at Saint Michael's, Coventry on 15 Feb 1877; sixteenthly, Susannah Lee's death [sic]; seventeenthly, that on 15 Feb 1884 Rebecca Barnes Marindin mortgaged her share to William Henry Hughes for repayment of £80 with interest; eighteenthly, the 17 Jun 1884 assignment by Rebecca B. Marindin (regarding her one-fifth subject to Thomas James Mercer [II]'s will's power of sale) and William Henry Hughes (for the whole of R.B. Marindin's interest) to David Spencer and Joseph Harrison [draper] of trusts in order to pay sale-proceeds for the one-fifth to R.B. Marindin, Charles Webb Iliffe and William Clarke for her benefit under the terms of John Lee's will, Samuel Henry Holland with his wife Ellen, Vincent Louis Frederic Marindin and Sarah Page also participating; nineteenthly, an agreement (no date) that the original one-fifth's purchase-money should be paid into the Coventry Union Banking Co. upon a deposit account in the names of R. Marindin, Charles W. Iliffe and W. Clarke (Vincent Louis F. Marindin, D. Spencer and J. Harrison also participated); twentiethly, that Spencer and Harrison sold realty covered by J. Lee's will, free from LV, as was accepted by R. Marindin, C.W. Iliffe and Clarke and by R. Marindin herself [N.B.: William Satchwell Mercer's share in J. Barnes [I]' realty remains vested in Harrison because he and Spencer did not dispose of it]; twenty-firstly, that the £521/17/8 sale-proceeds of the one-fifth had been banked; twenty-secondly, that the Marindins and Adamses had claimed entitlement to set aside LIV in order to place the £521/17/8 in the names of Thomas James Mercer [III] (of Coventry, watch-manufacturer), Reverend Harry Stanley Mercer (of Ballarat, Victoria, Australia, clerk in Holy Orders, per Thomas James Mercer [III] under a 17 Mar 1885 letter of attorney) and Frank Louis Mercer (of Albermarle House, Albermarle Street, Middlesex, land agent) paid to them or have her share of J. Barnes [I]' hereditaments conveyed to them; but twenty-thirdly, that doubts had arisen about the Marindins' claims, so it had been agreed that moneys should be paid to R. Marindin if she paid Thomas James Mercer [III] et al £40: therefore, in consideration of discharge of LV, Spencer, and (in consideration of 5/- paid to each of them) Rebecca Barnes Marindin (the wife of Vincent Louis Frederic Marindin of Liverpool, Lancashire, teacher of languages), Charles Webb Iliffe (surgeon) and William Clarke (chemist), both of Coventry, released to R. Marindin her shares under J. Barnes [I]' will; moreover (in consideration of £133/6/8 for each of Thomas J. Mercer [III], Reverend Harry Stanley Mercer and Frank Louis Mercer) R. Marindin, C. Iliffe, Clarke and Vincent L.F. Marindin conveyed to R. Marindin the £521/17/8 (Sylvester Richard Masser (of Coventry, solicitor) also participated).
LVIII 16 Feb 1887. Mortgage whereby, having recited: firstly to thirdly, Joseph Barnes [I]' will, codicil and death; fourthly to sixthly, Rebecca Barnes', Joseph Barnes [II]' and Edward Turner Barnes' deaths; seventhly, Susannah Lee's children; eighthly, her death; ninthly, that Rebecca Barnes Lee married Thomas James Mercer [II]; tenthly, William Barnes Lee's will, death and probate; eleventhly, Elizabeth Lee's will and administration with the will annexed; twelfthly and thirteenthly, LIV, LV; fourteenthly, discharge of the £420; fifteenthly, Thomas J. Mercer [II]'s will; sixteenthly, his death and probate; seventeenthly, LVI; eighteenthly, that Rebecca Barnes Mercer remarried to Vincent Louis Frederic Marindin; nineteenthly, Susannah Lee's death [sic]; twentiethly, LVII; and twenty-firstly, that Sarah Page (of Coventry, widow) had agreed to lend Rebecca Barnes Marindin £200: therefore the latter charged her interest under J. Barnes [I]', William B. Lee's and Elizabeth Lee's wills therewith for redemption at £5% per annum interest on 16 Aug [1887].
LIX 22 Dec 1882. Assignment of Mortgage, supplemental to LVIII, whereby, having recited that the principal alone was due, for 5/- Sarah Page transferred the charge to William Clarke and Sylvester Richard Masser.
LX 8 Sep 1887. Will of Rebecca Barnes Marindin which appointed William Clarke (chemist) and Sylvester Richard Masser (solicitor), both of Coventry, her trustees and executors; moreover, in the light of LVI, she entrusted them with all her estates in order to pay one-third of sale-proceeds to Vincent Louis Frederic Marindin until her son Louis Henri Marindin was of age (they to deal with it if the widower remarried or died before then), the other two-thirds for Louis Henri Marindin as the trustees thought fit until he reached 21.

LXIII 2 Oct 1888. Assignment whereby, having recited: firstly, LV; secondly, the Marindin marriage; thirdly, LVIII; fourthly, that the principal and interest were due; fifthly, irrelevant [sic]; sixthly, Rebecca Barnes Marindin's will, death and probate; seventhly that, at the time of her death, Rebecca B. Marindin and her husband owed money as scheduled; eighthly, that Vincent Louis Frederic Marindin (of Grantham, Lincolnshire, teacher of languages) claimed household goods and an insurance policy, and that R.B. Marindin's will only operated as regarded her share of Joseph Barnes [I]' estate; ninthly, irrelevant; and tenthly, that it had been agreed that William Clarke and Sylvester Richard Masser should sell the deceased's effects in order to pay several scheduled debts and £100 to the widower and to use the rent on her residuary estate, if necessary mortgaging her share under J. Barnes [I]' will but retaining third-scheduled plate for Louis Henri Marindin: therefore W. Clarke and Sylvester R. Masser transferred to Vincent Louis Frederic Marindin the one-third share of R. Marindin's entitlement under J. Barnes' will.
LXIV 1892. Reconveyance whereby, having recited: firstly, that that deed was supplemental to LXIII; secondly that, under LIX, any mortgage vested in William Clarke and Sylvester Richard Masser; thirdly, that counsel had advised that conveyance of the one-third affected by LIX was invalid because it was not the sort of transaction that Joseph Barnes [I]' will authorised; however, fourthly, that it had been agreed that Vincent Louis Frederic Marindin should return the share to W, Clarke and Sylvester R. Masser: therefore that was done, subject to LVIII, provided that the principal and interest were not merged into the equity of redemption.

N As to the Dealings by the Devisees under the Will of John Lee, deceased with the Share of William Satchwell Mercer
LXV 15 Feb 1884. Mortgage whereby having recited: firstly, John Lee's wiil, death and probate; secondly, his six children; thirdly, William Barnes Lee's will, death and probate; fourthly, Thomas Hall Page's death; fifthly, Elizabeth Lee's death and grant of letters of administration with the will annexed to Rebecca Barnes Marindin; sixthly and seventhly, LIV LVI; eighthly, the Marindin marriage; and ninthly, that Rebecca B. Marindin had asked William Henry Hughes (of Coventry, bank cashier) to lend her £80: therefore R.B. Marindin covenanted to repay such a sum on 15 Aug [1884] at £5% per annum interest, charged upon her interest under J. Lee's, William B. Lee's and E. Lee's wills.

Holland, R.B. Marindin, Vincent Louis Frederick Marindin, Sarah Page, Charles Webb Iliffe, William Clarke and William H. Hughes had agreed to entrust Davd Spencer and Joseph Harrison (of Coventry, woollen merchants) with the estate: therefore the Hollands (as regarded one-fifth under J. Lee's will and one-quarter of one-fifth under W.B. Lee's), the Hollands and Marindins (regarding the wives' estate as E. Lee's co-heiresses), R. Marindin (as E. Lee's personal representative for one-fifth received under J. Lee's will and one-quarter of one-fifth under W. Lee's), S. Page (for one-fifth left to Sarah P. Lee under J Lee's will and one-quarter of one-fifth left to the same beneficiary under W. Lee's) and R. Marindin, Charles W. Iliffe and W. Clarke (respecting one-fifth left by J. Lee to R. Marindin as trustees under T.J. Mercer [II]'s will) entrusted David Spencer and Joseph Harrison with first- to fifth-scheduled hereditaments (all irrelevant) and any other of J. Lee's estate; moreover, R. Marindin (as regarded one-quarter of one-fifth under W. Lee's will) assigned her share under LVI to D. Spencer and J. Harrison, as did W.H. Hughes on her behalf: all to be held in trust for sale, with power meanwhile to lease properties for up to seven years and deliver clear profits from their one-fifth to the Hollands one-fifth equally between E. Holland and R. Marindin, one-fifth to R. Marindin, C.W. Iliffe and Clarke and one-fifth so that one-fifteenth would pass to the Hollands, one-fifteenth be shared between E. Holland and R. Marindin and one-fifteenth between (1) S. Page, (2) R. Marindin with IIiffe and Clarke and (3) R. Marindin by herself.
LXVII 20 Sep 1884. Confirmation whereby, having recited: firstly, William Barnes Lee's will, death and probate; secondly, his entitlement to a one-fifth share in his late father John's estate; thirdly, Rebecca Barnes Lee's successive marriages; fourthly, Susannah Lee's death; fifthly, LXVI; and sixthly, that doubts had arisen as to whether LXVI had properly conveyed the Marindins' share under William B. Lee's will; therefore for 5/- Vincent Louis Frederic Marindin and Rebecca Barnes Marindin confirmed to David Spencer and Joseph Harrison a one-quarter of a one-fifth share under W.B. Lee's will of the first- to fifth-scheduled hereditaments and any other property.

Street South, Brooklyn, New York, United States of America, printer) and his wife Ellen except for what they claimed under XXXV and LXVI) to William Clarke, Joseph Anstey and Thomas J. Mercer [III]: therefore W. Clarke, J. Anstey, T.J. Mercer [III], the Winches, Reverend Harry Stanley Mercer, Frank Louis Mercer and Charles Webb Iliffe entrusted Sylvester Richard Masser (of Coventry, solicitor) with scheduled premises and whatsoever else they might be entitled to under J. Barnes [I]' will so that Charles W. Iliffe, Clarke and T.J. Mercer [III] might hold them in trust with power to sell and hold the proceeds according to the proportions that interested each party, Ellen Holland's and Harriett Winch's shares being for their separate use; the trustees might lease for up to 21 years.
