Whereby, having recited: firstly, William Aston Lee's will as in CCA/2/3/446/28; secondly, that he died in Oct 1841 and that the will was proved on -th. - 18- at -; thirdly, CCA/2/3/446/29; fourthly, CCA/2/3/446/30(main deed); fifthly, CCA/2/3/446/30(endorsement); sixthly, CCA/2/3/446/33.IV; seventhly, that Elizabeth Lee died during Oct 1857 and was buried in the Church of England cemetery, Birmingham, Warwickshire; eighthly, that John Lee died on 23 Oct 1858, having made his will (as at PA56/48/6) which was proved on 2 Jul 1859 at Birmingham; ninthly, that William Henry Seymour died during 1859 and was buried at Allesley, Warwickshire; tenthly, that [the tax assessor] Thomas Hall Page [who was John Lee's executor along with David Spencer (in 1880 described as of Coventry, woollen draper) and Susannah Lee (in 1880 of Coventry, widow)] died on 12 Aug 1866 and was buried at Stoke near Coventry; eleventhly, CCA/2/3/446/33.V; twelfthly, that John Topham died on 6 Jun 1870 and was buried at Alfreton, Derbyshire; thirteenthly, that James Lee died on 9 Jan 1874 and was buried in Coventry Cemetery; fourteenthly, that £187 principal and £2/17/6 interest are owed to Henry Ingles Davis (of Coventry, solicitor) under CCA/2/3/446/29; fifteenthly, that £1,300 plus interest is owing to that man under CCA/2/3/446/33.IV; and sixteenthly, that he has contracted to sell the premises to John Toye (of Coventry, gentleman) for £360: therefore (in consideration of payment by John Toye of £189/7/6 to David Spencer and Susannah Lee and £170/2/6 to Henry Ingles Davis) Henry I. Davis conveys to J. Toye premises as CCA/2/3/446/30(b), now comprising three messuages numbered 1-3, Saint Michael's Churchyard, on the corner of Bayley Lane (occupied by John Owens, William Cook and Edward Reading), discharged from the £1,300; D. Spencer and S. Lee assign to Toye everything covered by CCA/2/3/446/29, freed from the £187 plus interest so as to merge the term in the freehold; H. I. Davis covenants to produce the originals of CCA/2/3/446/33.V,III, William Thomas Wood (of Coventry [no quality]) CCA/2/3/446/33.IV's.
