Reciting PA686/9. In his will dated 2 Oct 1848, David Shakespear Waters devised the property described below to his son David Waters and to Thomas Dudley Brown and John Gulson in trust for his daughter Mary Sandiers and, after her death, to her husband Charles Sandiers and their children and, if there are no children, to the children of David Waters. DS Waters died 20 Feb 1849; will proved 2 Mar 1849. Charles Sandiers died 2 Mar 1880; Mary Sandiers died 29 Mar 1888, without having had any children. David Waters married Elizabeth Ann Massey at Kempsey, Worcestershire, on 23 May 1844. They had 5 children: Arthur Massey Waters (now Arthur Massey Spencer) born 19 Mar 1845; Georgina Waters born Mar 1846 and died 13 Aug 1846; Charles Henry Waters born 24 Dec 1847; Reginald Waters born 29 Aug 1848 and Hubert David Waters born 12 Sep 1854. Elizabeth Ann Waters (nee Massey) died 10 Nov 1862, buried at Keresley. David Waters remarried - to Louisa Henrietta Read at Leamington on 4 Aug 1864 and they had 7 children: Ernest Read Waters born 5 Oct 1865 and died 28 Aug 1869, buried at Keresley; Elizabeth Mary Waters born 19 Jan 1867; Margaret Louisa Waters, born 4 Mar 1868; Edward Shakespere Waters born 11 Aug 1869 and died 15 Sep 1869, buried at Keresley; Edith Beatrice Waters born 26 Sep 1867 and died 8 Feb 1871, buried Keresley; Jessie Waters born 11 Jun 1872; and Berham Herbert Waters born 1 Jul 1876 and died 20 Aug 1876, buried at Keresley. By deed poll dated 11 Aug 1888, Arthur Massey Waters adopted the name Arthur Massey Spencer. Charles Henry Waters in his will dated 7 Mar 1891 left his estate to his wife Mary Ann Waters; he died 13 Aug 1892 seized of one seventh of the property; his will was proved 22 Sep 1892; by an Order of the High Court of Chancery dated 28 Jul 1893 Hubert David Waters and George Hayden were appointed as trustees of this one seventh of the property. Reginald Waters by his will dated 13 Apr 1883 devised all his property in the County of Waitamata, province of Auckland, New Zealand, and all his other real estate to Thomas Taylor Masefield, John Foster and Arthur Massey Spencer (then Waters) in trust to sell the same. He died on 2 Mar 1886 seized of one seventh of the property . His will was proved on 18 Jan 1889. By an indenture dated 22 Jan 1894 John Foster discharged his responsibilities as trustee to the two other trustees of the will and by an indenture dated 23 Jan 1894 William Ranby Goate was appointed trustee instead of Thomas Taylor Masefield. By an indenture dated 20 Nov 1890 Hubert David Waters mortgaged to Thomas Browett his share of the property for £500; by an indenture dated 21 May 1894 Browett reconveyed this share back to Waters, the mortgage having been repaid. NOW, for £114 5sh 8d paid by Iliffe to each of Arthur Massey Spencer, Hubert David Waters, Elizabeth Mary Waters, Margaret Louisa Waters and Jessie Waters, and for £114 5sh 10d paid by Iliffe at the direction of Mary Ann Waters to Hubert David Waters and George Hayden, and for £114 5sh 10d paid by Iliffe to Arthur Massey Spencer and William Ranby Goate, the following property is conveyed to Iliffe:- the messuage etc at 26 Warwick Row (415 square yards) formerly occupied by Mary Sandiers, afterwards Reverend Henry Armstrong, now William Isaac Iliffe, bounded on the north by leasehold property lately sold to Iliffe, on west by messuage lately sold to James Westley, and on east by messuage belonging to the devisees of John Hill deceased. PLAN in margin of deed.
