Having recited: firstly, the 30-31 Aug 1811 lease and appointment as in PA194/12/12; secondly, that the children of William [Richard] Hopkins Northey (now residing at Brussels, Netherlands, esq.) are Richard Arthur Fortescue Hopkins Northey, Fanny Elizabeth Hopkins Northey his eldest daughter and four other daughters; thirdly, that Fanny Elizabeth Hopkins Northey is to marry the Honourable George Ives Irby, eldest son and heir of the Right Honourable George, Lord Boston; fourthly, that the Honourable George Ives Irby has agreed to execution of PA194/12/18; and fifthly, PA194/12/18: therefore for 10/- Fanny Elizabeth H. Northey entrusts the Honourable Thomas John Hamilton Fitzmaurice (alias Viscount Kirkwall, grandson and heir of the Right Honourable Mary, Countess of Orkney) and William Holmes (of Grafton Street, Middlesex, esq.) with the Warwickshire, Coventry and Buckinghamshire lands as presently constituted, subject to the 1811 appointment's uses and then successively to herself until marriage, her father for his other daughters' benefit, and the trustees during her lifetime to preserve contingent remainders and pay profits either to her appointee or to herself by default; she may assist any bodily heirs to secure title; after she has died, the property will be to the successive uses of George Ives Irby for life, the couple's second son and issue, younger sons and issue by seniority, the first son and issue, each daughter and her heirs by seniority, all William [Richard] Hopkins Northey's daughters and heirs as tenants in common with cross-remainders, and Lieutenant-General Richard [Northey] Hopkins' right heirs: if the second son or any subsequent heir accede under an appointment of this date (made between George, Baron Boston of Lincolnshire and George I. Irby of the first part, Fanny E.H. Northey of the second, William [Richard] H. Northey of the third, Thomas de Grey and Bennett Gosling (of Lincoln's Inn, esqs. [barristers]) of the fourth, and Viscount Kirkwall and William Holmes of the fifth) regarding Lincolnshire, Northamptonshire, Buckinghamshire, Middlesex and Anglesey land belonging to the Irbies so that he become entitled to its property, this deed's provision will cease to apply to him and it will descend directly to the couple's first son and heirs, but then to younger sons and heirs and the above uses; anyone becoming entitled to this deed's property shall enter into it within three months, and shall during that time assume the name of Hopkins and apply for a licence to that effect within six months of acceding, upon pain of forfeiting the estate in favour of the next in line; F.E.H. Northey, G.I. Irby (for his infant heirs), the Honourable Thomas John Hamilton Fitzmaurice and W. Holmes may create leases of at most 21 years and may re-enter if a rent fall thirty days behindhand; Thomas John Hamilton Fitzmaurice and Holmes may sell or exchange property in order to discharge encumbrances; copyholds or leaseholds may form at most one-eighth of the whole estate; Thomas John H. Fitzmaurice and Holmes may place profits in stocks for trustees to dispose of; the couple may appoint new trustees, as may successors in title or their guardians.
