Reciting the following which relate to the property in Coventry as part of the larger estate of the Lords Boston and the passing of the property down from one member of the family to another:
Indenture of settlement dated 13 Feb 1865 in which George Ives Lord Boston conveyed to Augustus Antony Frederick Irby and Frederic Drake lands at Barston, Stoneleigh, East end, Hawkesend, Allesley, Foleshill, Shortley, Pinley, and the parishes of St Michael and Holy Trinity, Coventry, in trust to the use of Lord Boston himself and his only son, Florance George Henry Irby and the latter's heirs.
Will of Florance George Henry Irby dated 10 Apr 1865 appointing his wife Augusta Caroline Irby as his executrix and leaving the lands in the deed above to his eldest son when he reaches the age of 21.
Death of George Ives Lord Boston, 22 Dec 1869.
Death of Augustus Antony [Frederick] Irby, Apr 1870.
Death of Florance George Henry Irby (by this time Florance Lord Boston) on 4 Jan 1877, leaving three sons all aged under 21.
Indenture dated 27 Mar 1877 in which F Drake appointed Augustus Arthur Vansittart of Cambridge as his co-trustee for the estate (following the death of FGH Irby).
Indenture dated 17 Jun 1880 in which Drake and Vansittart appointed John Wingfield Malcolm of Argyllshire as trustee to replace Drake.
On 6 Sep 1881 George Florance Lord Boston, the eldest son of the late Florance George Henry Lord Boston, attained the age of 21.
By a disentailing deed dated 31 Dec 1881 George Florance Lord Boston granted the properties which were subject to the 1865 deed of settlement to Edward Partington in trust for the use of Lord Boston and his heirs.
Indenture of confirmation and settlement dated 3 Jan 1882 between George Florance Lord Boston and William Chilver Boodle in which it was recited that the three sons of the late Florance George Henry Lord Boston at the time of his death were George Florance Irby (who became Lord Boston), Cecil Saumarez Irby and Gilbert Neville Irby, all of whom were aged under 21 when their father died. Doubts had subsequently arisen about the effectiveness of the wording in the will with regard to implementing the actual intentions of the testator. Therefore, in order to give effect to his father's will, George Florance Lord Boston had entered into the disentailing deed of 31 Dec 1881 (recited above) and now entered into this deed in which the properties as in the 1881 deed (these are not detailed) are conveyed to Boodle in trust for Cecil Saumarez Irby until he reached the age of 21.
On 3 Feb 1883 Cecil Saumarez Irby attained the age of 21.
Declaration dated 8 Dec 1885 by Augusta Caroline Lady Boston (by then the wife of Sir Henry Percy Anderson of Cookham, Berkshire) that she married Florance George Henry Irby (later Lord Boston) on 27 Oct 1859 and that Cecil Saumarez Irby is their second son born 3 Feb 1862.
Indenture dated 30 Jan 1885, marriage settlement between Cecil Saumarez Irby, Captain in the 7th Battalion Kings Royal Rifle Corps, and Florence Augusta Upton-Cottrell-Dormer of Ingmire Hall, Yorkshire, in which Irby conveys to his trustees (Clement Adelmar Cottrell-Dormer of Ingmire Hall Esq and Philip Lyttleton Gell of London Esq) the lands (as in the 1865 deed of settlement) in trust for himself, his wife and their heirs.
Indenture dated Sep 1901 in which John Henry Cottrell-Dormer of Cokethorpe Park, Witney, Oxfordshire, was appointed trustee of the marriage settlement to replace CA Cottrell-Dormer.
Indenture dated 7 Jun 1903 in which Cecil Pugh of Briarwood Sedburgh Esq was appointed trustee instead of JH Cottrell-Dormer.
The following relate specifically to the property in Coventry:-
Indenture dated 8 Sep 1913, conveyance from Cecil Saumarez Irby of The Grange, Hitcham, Buckinghamshire, and his trustees PL Gell (now of Hopton Hall, Derbyshire, Esq) and Cecil Pugh (now of Swanage, Dorset, Esq) to Walter Phillips, gentleman, Walter Herbert Hattrell, architect and surveyor, and Charles James Band, solicitor, all of Coventry, for £2000 of the following lands:-
(1) a piece of land (16 acres 3 roods 35 poles) in the parish of St Michael, Coventry, bounded on the east by land recently sold to the London and North Western Railway Company Ltd, on the north west by property of Colonel Wyley, on the west by the river Sherbourne, on the north by land called the Gosford Park Building Estate conveyed to George Nicholls and Charles James Band;
(2) another piece of land (11 acres 3 roods 20 poles) in the parish of St Michael, partly within and partly without the City of Coventry, bounded on the west by land recently sold to the L and NW Railway Co Ltd, on the north by Gosford Park Building Estate and on the east partly by the Gosford Park Building Estate and partly by Folly Lane.
PLAN attached. Covenants to construct streets at points marked on the plan.
Orders dated 4 Jul 1912 of Warwickshire Quarter Sessions for footpath diversions.
Orders dated 3, 23 Jul 1913 of Warwickshire Quarter Sessions for the completion of new streets and new footpath respectively.
